Eligibility Requirements for TN (NAFTA Professionals) Visa
Canadian Citizens
Canadian citizens are generally eligible for a TN visa at a U.S. port of entry. However, they may also apply for a TN visa at a U.S. Embassy or Consulate before traveling to the United States. A Canadian citizen without a TN visa can apply for admission to TN status at a U.S. port of entry.
The Canadian citizen must provide the following documents to the U.S. Customs and Border Protection (CBP) officer:
- Proof of Canadian citizenship
- Letter from the employer detailing the professional position
- Proof of professional qualifications
- Proof of intent to return to Canada at the end of the temporary stay in the United States
- Proof of payment of the USCIS filing fee
Mexican Citizens
Mexican citizens must obtain a TN visa from a U.S. Embassy or Consulate before traveling to the United States.
A Mexican citizen must provide the following documents to the U.S. Embassy or Consulate:
- Proof of Mexican citizenship
- Letter from the employer detailing the professional position
- Proof of professional qualifications
- Proof of intent to return to Mexico at the end of the temporary stay in the United States
- Proof of payment of the USCIS filing fee
Renewal of TN (NAFTA Professionals) Visa
A TN nonimmigrant may apply to renew their TN status for an additional period of one year. There is no limit on the number of times a TN nonimmigrant may renew their TN status. A Canadian or Mexican citizen may apply to renew their TN status with U.S. Customs and Border Protection (CBP) at a U.S. port of entry.
The TN nonimmigrant must provide the following documents to the CBP officer:
- Valid passport
- Form I-94, Arrival/Departure Record
- Letter from the employer detailing the professional position
- Proof of professional qualifications
- Proof of intent to return to the foreign country at the end of the temporary stay in the United States
- Proof of payment of the USCIS filing fee
Change of Employer
A TN nonimmigrant may change employers. If the TN nonimmigrant is a Canadian citizen, the TN nonimmigrant may apply for admission in TN status with U.S. Customs and Border Protection (CBP) at a U.S. port of entry.
