What You Need to Know About Working in the U.S.

The most common type of visa issued to temporary workers is an H visa. Immigrants with an H-1 visa are limited to staying in the U.S. for six years while immigrants with an H-2 visa are limited to three years.

There are several different types of H visas, including:

  • H-1A visas for registered nurses
  • H-1B visas for specialty occupations
  • H-2 visas for agricultural workers

In order to secure a job in the U.S., your potential employer will need to prove to the Department of Labor that there were no American citizens that were willing and able to take the job. They also must show that the job was being offered at an acceptable wage that is comparable to other salaries for that position. Next, your potential employer needs to petition for your visa on your behalf. Once their petition is approved, you can start your side of the visa application process.

Potential Complications for Temporary Workers

Congress has set limitations on the amount of foreign temporary workers allowed in the U.S. at one time. Even if you are offered a job and given a visa, you may be required to wait to travel. Issues can arise if you change employers or if your company is bought out by another company. Sometimes, your new employer may be required to petition for you all over again.
